Our service may include automated photo processing, AI-assisted adjustments, background replacement, cropping, resizing, compliance formatting, quality enhancement, human review, or manual retouching, depending on the service selected.

We aim to help users create high-quality document photos that meet the selected requirements. However, final acceptance of any photo is determined by the relevant government agency, institution, platform, or authority.

2. Use of the Service

You agree to use IDPhotoAI only for lawful purposes and in accordance with these Terms.

You agree not to:

Upload photos that you do not have the legal right to use
Upload images involving illegal, harmful, abusive, or misleading content
Use our service to create fraudulent, forged, deceptive, or unlawful documents
Attempt to bypass, interfere with, or damage our website or systems
Abuse refund policies, payment systems, or customer support
Use automated tools, bots, or scraping systems without permission
Copy, resell, or redistribute our service, website content, or generated outputs as a competing service

We reserve the right to refuse service, suspend access, or remove content if we believe your use violates these Terms or applicable laws.

3. User Responsibilities

When using IDPhotoAI, you are responsible for:

Uploading a clear and appropriate source photo
Selecting the correct photo type, country, document type, or size requirement
Reviewing the generated result before using it
Ensuring that the final photo is suitable for your specific application
Providing accurate information when contacting support or requesting a refund

You understand that different authorities may have different photo requirements, and requirements may change over time.

4. Photo Requirements and Acceptance

IDPhotoAI makes reasonable efforts to generate photos according to the selected specifications, such as size, background, head position, cropping, and general compliance standards.

However, we cannot guarantee that every photo will be accepted by every government agency, visa center, passport office, school, employer, platform, or other authority.

Reasons for rejection may include, but are not limited to:

Different interpretation of photo requirements by the reviewing authority
Outdated or changed official requirements
Low-quality original photo uploaded by the user
Face obstruction, shadows, blur, incorrect posture, or unsuitable expression in the original image
User selecting the wrong document type, country, size, or photo specification
Printing issues caused by third-party printers or incorrect print settings
Additional requirements not provided to or supported by IDPhotoAI

Although acceptance is ultimately controlled by the reviewing authority, we provide a refund policy for rejected applications as described below.

5. Refund Policy for Rejected Applications

If a photo generated by IDPhotoAI is rejected when used for an official application, we offer a full refund.

Your order email or account email
Order number or payment reference, if available
The photo type you purchased
A brief explanation of the rejection
Any rejection notice, screenshot, or feedback from the relevant authority, if available

Once we receive your request, we will review it and process a full refund if your request is related to the rejection of a photo generated by IDPhotoAI.

This refund policy applies to cases where the photo generated by IDPhotoAI was used for an application and was rejected due to photo compliance or photo suitability issues.

We may refuse or limit refund requests if we reasonably believe there is fraud, abuse, repeated misuse, false information, or violation of these Terms.

6. Pricing and Payments

Some IDPhotoAI services may require payment.

By purchasing a service, you agree to pay the listed price at the time of purchase. Prices may vary depending on the selected service, photo type, review level, retouching option, or promotional offer.

Payments may be processed by third-party payment providers. We do not directly store your full credit card number or full payment credentials.

Prices may change from time to time. Any price change will not affect orders that have already been completed.

7. Delivery of Digital Products

IDPhotoAI provides digital photo products. After processing, your generated photo may be available for preview, download, or delivery through the website or email, depending on the service flow.

You are responsible for downloading and saving your generated photo within the available access period.

As described in our Privacy Policy, uploaded photos and generated ID photos are retained for only 7 days and are then automatically and permanently deleted from our platform.

8. Uploaded Photos and User Content

You retain ownership of the photos you upload and the personal content you provide.

By uploading a photo to IDPhotoAI, you grant us a limited, temporary, non-exclusive permission to process, edit, crop, resize, enhance, store, and generate output images solely for the purpose of providing the service you requested.

We do not claim ownership of your uploaded photos.

We do not use uploaded photos or generated ID photos for AI model training, machine learning training, dataset building, advertising, resale, or unrelated business purposes.

9. Intellectual Property

All rights, title, and interest in IDPhotoAI, including the website, design, branding, software, interface, technology, text, graphics, logos, and service structure, are owned by IDPhotoAI or its licensors.

You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of our website or service unless we provide written permission.

You may use the generated photo output for your personal application, official document, or intended lawful purpose.

10. Prohibited Uses

You may not use IDPhotoAI to:

Create fake, misleading, fraudulent, or deceptive identity materials
Impersonate another person
Violate any law, regulation, or third-party right
Upload photos of another person without proper permission
Submit harmful, abusive, obscene, or illegal content
Attempt to gain unauthorized access to our systems
Interfere with the normal operation of the website
Abuse promotions, refunds, payment systems, or support channels
Use IDPhotoAI as part of a competing commercial service without authorization

We reserve the right to suspend or terminate access if we believe these rules have been violated.

11. No Guarantee of Official Acceptance

Although IDPhotoAI is designed to help create compliant ID photos, we do not control the decisions of government agencies, visa centers, passport offices, schools, employers, platforms, or other reviewing authorities.

Therefore, we do not guarantee that any photo will be accepted in every situation.

Your remedy for rejection is described in our refund policy above.

12. Disclaimer of Warranties

IDPhotoAI is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not warrant that:

The service will be uninterrupted or error-free
The generated photo will always meet every possible official requirement
The website will be free from defects, viruses, or harmful components
Any specific authority will accept the generated photo

13. Limitation of Liability

To the fullest extent permitted by law, IDPhotoAI shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

Application delays
Rejected applications
Missed appointments
Travel losses
Visa or passport delays
Lost profits
Loss of data
Third-party printing issues
Decisions made by government agencies or other authorities

Our total liability for any claim related to a paid order shall not exceed the amount you paid to IDPhotoAI for that specific order.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless IDPhotoAI, its owners, operators, affiliates, service providers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising from:

Your use of the service
Your uploaded photos or content
Your violation of these Terms
Your violation of any law or third-party right
Your misuse of generated photos
Any false, misleading, or unauthorized information you provide

15. Account Suspension and Termination

We may suspend, restrict, or terminate your access to IDPhotoAI at any time if we reasonably believe that:

You violated these Terms
You used the service unlawfully
You abused the refund policy
You attempted to harm or disrupt the service
Your activity creates risk for IDPhotoAI, other users, or third parties

You may stop using IDPhotoAI at any time.

IDPhotoAI may rely on third-party services for hosting, storage, payment processing, analytics, email delivery, AI processing, or customer support.
